Criminal Defense
A criminal conviction can result in a fine, probation, and jail sentence. A conviction can destroy your reputation, relationships, and employment opportunities. If you are a non-citizen legally residing in the United States, a criminal conviction can result in deportation. If you have been arrested on a criminal charge and you are a resident alien, undocumented alien, or you overstayed your visa, you need legal assistance in two areas: the criminal charge and advice of any immigration consequences.
The U.S. Supreme Court issued an important decision in Padilla v. Kentucky in 2010. The Sixth Amendment to the U.S. Constitution requires criminal defense attorneys to provide affirmative, competent advice to non-citizens about immigration consequences related to a criminal conviction. If an attorney fails to give this advice, the non-citizen can bring a claim of ineffective assistance of counsel.
We represent clients in criminal matters including driving while intoxicated, domestic violence and most misdemeanor matters. When necessary to effectively represent you in felony matters, we may consult with other criminal attorneys in order to provide the best possible outcome.
